2018 Drug & Alcohol Abuse Program Notice
Consistent with the Drug Free Schools and Communities Act of 1986, the San Diego Community College District (San Diego City College, San Diego Mesa College, San Diego Miramar College and San Diego Continuing Education) is committed to providing a safe and drug-free learning environment that promotes student academic achievement. The San Diego Community College District (SDCCD) also prohibits the use of tobacco products and electronic delivery devices on any SDCCD campus/district property or at any SDCCD campus/district sponsored events. Any type of illegal substance use or legal substance abuse, including prescription drugs and alcohol, is dangerous and potentially life threatening. Drugs and alcohol adversely affect the body, mind and behavior. The effects vary from person to person and from usage to usage. Even low doses of drugs or alcohol can impair judgment and coordination. If you use drugs or alcohol, you risk overdose, accidents, dependence, ill health, as well as legal, financial and personal problems.
The SDCCD has developed a comprehensive Drug & Alcohol Abuse Program directed to all students and employees of the SDCCD. The unlawful possession, purchase, manufacture, use, sale or distribution of illicit drugs and alcohol by employees on any SDCCD campus/district property or at any SDCCD sponsored activity is prohibited. SDCCD will impose sanctions, consistent with local, State, and Federal law, for violations of alcohol and drug policies as stated within SDCCD District policies or SDCCD employee handbooks/manuals. Disciplinary action for employees may include corrective discipline, counseling, reassignment, verbal warnings, documented warnings, suspension with or without pay, or termination of employment for employees and/or referral to local law enforcement for prosecution.
San Diego Community College District and California Proposition 64
On November 8, 2016, California passed Proposition 64. Proposition 64 legalized the recreational use of marijuana for adults aged 21 years or older, permitting smoking in a private home or at a business licensed for on-site marijuana consumption only.
Smoking was to remain illegal while driving a vehicle, anywhere smoking tobacco is prohibited, and in all public places. Proposition 64 also upheld the right and obligations of public and private employers to maintain a drug and alcohol free workplace, which includes the ability of employers to have policies prohibiting the use of marijuana by employees and prospective employees. Proposition 64 also made clear that its provisions do not prevent employers from complying with state or federal law.
The SDCCD observes Board Policy 3550, which states the following:
“The District shall be free from all drugs and from the unlawful possession, use, or distribution of alcohol and illicit drugs and alcohol by students and employees. The unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in all facilities under the control and use of the District. Any student or employee who violates this policy will be subject to disciplinary action consistent with local, state, or federal law, which may include referral to an appropriate rehabilitation program, suspension, demotion, expulsion, or dismissal. The Chancellor shall assure that the District distributes annually to each student and employee the information required by the Drug-Free Schools and Communities Act Amendments of 1989 and complies with other requirements of the Act. Therefore, while on any SDCCD property the possession, use or distribution of marijuana by an SDCCD student, an SDCCD employee and any and all visitors to any SDCCD campus/district property is strictly forbidden.
